Almost everyone today affirms the importance and merit of religious liberty. But religious liberty is being challenged by new questions (for example, use of the niqab or church adoption services for same-sex couples) and new forces (such as globalization and Islamism). Combined, these make the meaning of religious liberty in the twenty-first century uncertain. This collection of essays by ten of the world's leading scholars on religious liberty takes aim at these issues. The book is arranged around five specific challenges to religious liberty today: the state's responsibility to prevent coercion and intimidation of believers by others within the same faith community; the US's basic moral responsibilities to promote religious liberty abroad; how to understand and apply the traditional right of conscientious objection in today's circumstances; the distinctive problems presented by globalization; and the viability today of an 'originalist' interpretation of the First Amendment religion clauses.

The central claim of this book is that although the concept of religious freedom as a human rights concept is emblematic on the one hand, the concept is also problematic on the other, so that its implications are far from self-evident despite the ready acceptance the term receives as embodying a worthwhile goal. This book therefore problematizes the concept along legal, constitutional, ethical, and theological lines, and especially from the perspective of religious studies, so that religious freedom in the world could be enlarged in a way which promotes human flourishing.--

"Depuis la Déclaration de Vienne, adoptée en 1993, le principe de l'égalité hiérarchique entre les différents droits et libertés fondamentaux n'a jamais été remis en cause de manière significative au sein de la communauté internationale : tous les droits auraient la même valeur juridique et aucun de ceux-là ne pourrait primer sur les autres en cas de conflit. Le présent livre s'attaque à l'effectivité du postulat de non-domination des droits et des valeurs en étudiant les portées, très différentes, qui furent conférées, au Canada, à deux ensembles de droits et libertés fondamentaux.
